Gurugram hit-and-run: victim seeks strict action, says Bainsla arrest not enough

The woman biker who was struck by a car on Gurugram's Golf Course Road has said that the arrest of the prime accused is not sufficient, and demanded strict punishment for everyone who was in the vehicle at the time of the incident.

Sia, 27, spoke to the media on Tuesday night after recording her statement in the district court. She said two other people were in the car and should also be arrested. "They must be punished. If they aren't, such incidents will continue to happen," she said.

She also rejected the suggestion that the arrest amounted to firm action, noting that if the accused secures bail within three days it cannot be considered strict action.

Kalyan Bainsla, 33, and his cousin Lavneesh, 34, who was travelling with him, were arrested on Tuesday from Rajgarh in Rajasthan, a short distance from Gurugram, after a two-day search. The car, registered in the name of an acquaintance, was impounded.

According to police, Bainsla tried to escape custody after his arrest on the pretext of urinating, but fell and was injured. He was given first aid at a hospital. Both accused were produced in the city court.

Gurugram DCP (East) Sandeep Kumar said the victim had told the police that Bainsla hurled a slur at her before the incident and tried to kill her. "It can be clearly seen that he deliberately hit (the biker) from the side after an argument … the intent was to kill the victim," he said.

Police Commissioner Sibash Kabiraj said the attempt-to-murder charge was added after scrutiny of Instagram videos and CCTV footage. Bainsla had earlier given an interview to the media, switched off his mobile phone and absconded. Three teams were formed to track him down.

The case began after a woman biker shared a video on Instagram on September 14 showing that she had been struck by a car on Golf Course Road the previous morning. As no formal complaint had been filed, the police registered a suo motu case at the Sector-56 police station. After Bainsla's arrest, the biker joined the investigation, and on her complaint the police added provisions dealing with attempt to murder, physical and digital stalking, and acts against the modesty of a woman under the Bharatiya Nyaya Sanhita.

Sia also responded to remarks by Bainsla's cousin Kamal, who claimed the accused was innocent and that she was playing the victim card. She said his followers were making similar allegations and described their mentality as flawed. Recalling that she had contested the 2022 municipal election from Kalkaji in Delhi as the youngest candidate, she said she had initially not wanted to reveal her identity but would now stand firm for herself.

She said she told the court that an attempt had been made on her life and that she could have died. She has sought strict action in the case and said she has sustained injuries, with doctors advising an MRI and X-rays.
