The Kerala High Court has granted pre-arrest bail to a woman accused of throwing her newborn baby out of a hospital window, holding that the material on record does not establish an intention to cause the child's death.
Justice Kauser Edappagath, while considering the plea, observed that the accused had no prior criminal record, the investigation was nearing completion, and custodial interrogation did not appear necessary given the nature of the allegations against her.
The prosecution's case is that the woman, who is unmarried, went to the Taluk Headquarters Hospital in Haripad complaining of stomach pain. While she was under observation, she is said to have delivered the baby in the attached bathroom. According to the prosecution, she threw the infant through the window to avoid the consequences of the birth.
The woman has denied the allegations, maintaining that she is innocent and has been falsely implicated in the case.
The court allowed the bail plea subject to conditions. She must execute a bond of ₹1 lakh, cooperate fully with the ongoing investigation, report to the investigating officer once every week, and refrain from leaving the State without the permission of the trial court.
