Ladakh High Court Bench Moves Closer to Reality as Regulation Takes Effect
A regulation permitting High Court proceedings in Ladakh has come into force, a key step toward establishing a local bench.
A significant step toward establishing a High Court bench in Ladakh was taken this week, as a regulation enabling the High Court of Jammu and Kashmir and Ladakh to hold sittings within the Union Territory came into effect on September 5.
The regulation, promulgated by President Droupadi Murmu on August 27 and notified the same day by Lieutenant Governor VK Saxena, follows the Union Cabinet's approval of the proposal last month.
Currently, residents of Ladakh seeking to approach the High Court must travel outside the Union Territory. For those in remote and far-flung areas, this involves long journeys, significant expenses, and navigating difficult terrain and harsh weather conditions. The new bench is expected to substantially reduce these hardships by bringing court proceedings closer to the people.
While the regulation is now in force, the bench is not yet operational. The administration will need to collaborate with the High Court of Jammu and Kashmir and Ladakh on essential arrangements, including judicial and administrative frameworks, infrastructure, finances, and logistics.
Lieutenant Governor VK Saxena described the development as a "historic step towards bringing justice closer to the people," noting that it will make the judicial system more accessible for citizens in remote areas.
The formal measure, titled the Union Territory of Ladakh (Sitting of Bench of the High Court of Jammu and Kashmir and Ladakh in Ladakh) Regulation, 2026, lays the groundwork for the bench's eventual functioning. For litigants in Ladakh, the full impact will be felt once High Court proceedings can be heard closer to home, reducing the time, cost, and travel currently required to pursue cases outside the Union Territory.
