Returning from maternity leave? Delhi HC spells out employer's duty on job changes

Delhi HC: employers must inform and explain significant job changes to women on maternity leave before they return to work.

The Delhi High Court has clarified the legal safeguards available to women who return to work after maternity leave, ruling that employers cannot spring major changes on them without prior notice.

The court held that if an organisation intends to make a significant alteration to an employee's responsibilities, salary, grade, reporting structure, team, or place of work during her maternity leave, it must inform her in advance. The employer is also required to explain the reason behind the proposed change.

The ruling underscores that a woman on maternity leave is not expected to absorb sudden or unexplained disruptions to her professional standing upon her return. By mandating advance communication and a clear rationale, the court has sought to ensure that the period of leave does not become a ground for unilateral and opaque decisions that could disadvantage the employee.
