Mizoram Makes Court-Issued Divorce Certificate Compulsory for Remarriage
Mizoram now requires a court-issued divorce certificate for remarriage, with verification duties placed on the officiant.
Mizoram has made a court-issued divorce certificate mandatory for anyone seeking to remarry after a separation. The decision, announced on September 3 by the Review Committee on the Mizo Marriage and Inheritance of Property Act, brings significant changes to the state's marriage laws.
The committee, chaired by Law and Judicial Department Additional Secretary Zahmingthanga Ralte, reviewed existing customary practices against the provisions of the Mizo Marriage and Inheritance of Property (Amendment) Act, 2026. This amended legislation was passed by the Mizoram Assembly earlier this year, in February 2026.
Under the new rule, a divorced individual must prove that their previous marriage was legally dissolved through a valid court-issued certificate before entering into another marriage. The responsibility of verifying this certificate has been assigned to the person solemnising the marriage.
The committee has clarified that churches will continue to regulate marriage and remarriage within their respective jurisdictions. However, the legal requirement for a court-issued divorce certificate now applies uniformly to all divorced persons seeking remarriage.
The latest review was aimed at aligning the amended law with the state's existing customary practices, ensuring that legal dissolution of marriage is properly documented before a new union is solemnised.
