Muzaffarpur court issues NBWs against nine police personnel over no-show as witnesses
A Muzaffarpur court has issued non-bailable warrants against nine police personnel for failing to appear as prosecution witnesses in a 2018 arms case.
A court in Muzaffarpur, Bihar, has issued non-bailable warrants against nine police personnel after they failed to appear as prosecution witnesses in a case dating back to 2018.
Additional District and Sessions Judge-11 Dr Kishor Kunal passed the order on September 10. The court directed the prosecution to produce the witnesses and asked the Saraiya station house officer and the Muzaffarpur Senior Superintendent of Police to ensure their presence before it. The case has been listed for prosecution evidence on October 28.
According to the order, the matter was at the stage of prosecution evidence. Summons had been issued to the witnesses on May 8, 2025, and bailable warrants followed on August 20. When the witnesses still did not appear, the court instructed its office to issue non-bailable warrants against them.
The order names Sub-Inspectors Md Allauddin, Sattrudhan Sharma and Yogendra Kumar Singh; BMP havildar Sanjay Sharma; constables Abhay Kumar Singh, Azhar Khan and Rahul Kumar; driver Radhakant Prasad; and investigating officer Anil Kumar. All are described as being associated with Saraiya police station in Muzaffarpur district.
A copy of the order is to be sent to the Saraiya SHO and the Muzaffarpur SSP for the production of the witnesses. The court also directed the prosecution to produce them as per its priority.
The underlying case
The proceedings relate to a case registered after a police raid at the Bhagat Singh High School field in Manikpur on the night of September 17, 2018. As recorded in earlier bail orders, Saraiya police station SHO Md Allauddin received information around 9.30 pm that seven to eight criminals, allegedly armed, had gathered there to plan a crime.
A police team reached the spot with armed personnel. The prosecution case was that three men on two motorcycles fled on seeing the police, while the others allegedly tried to escape and were apprehended.
Material recorded by the court in the earlier bail proceedings states that searches conducted in the presence of independent witnesses led to the alleged recovery of a loaded country-made pistol and a live cartridge from one accused, and loaded country-made pistols and live cartridges from two others. The prosecution case further states that the three men could not satisfactorily explain the firearms and ammunition or produce documents relating to them.
The case was registered against all six accused under Sections 399, 402 and 34 of the Indian Penal Code and Sections 25(1-B)A, 26 and 35 of the Arms Act.
