Tate Brothers Seek Release From US Jail While Fighting UK Extradition
Andrew and Tristan Tate's lawyers filed for release in Miami federal court, citing their public profiles and past compliance as reasons they won't flee.
Attorneys for Andrew and Tristan Tate have asked a Miami federal court to release the brothers from custody while they contest extradition to the United Kingdom, where they face charges of rape and sex trafficking. The defense filed a motion on Friday arguing that the influencers' high-profile lives and their record of complying with legal restrictions in Romania constitute "special circumstances" that justify bail.
The brothers have been held at the Federal Detention Center in Miami since their arrest on July 18. A judge is expected to decide next week whether they will remain in jail during what could be a months-long extradition process. Prosecutors have until Monday to respond to the motion.
The defense acknowledges that extradition cases typically presume detention, but argues that the Tates' fame makes it nearly impossible for them to disappear. Their lawyers point out that the brothers regularly post their whereabouts on social media and have fully complied with all pretrial conditions in Romania, where they face separate allegations of sexual exploitation.
"Every prediction the government now asks this Court to make about the brothers' future conduct — that they will flee if released — has already been made and answered by three years of data showing that they do not flee," the motion states.
The UK has until mid-September to submit evidence to the US State Department to support the extradition request, which could mean the brothers remain in detention for several more months. They are being held in a special unit for their own protection, with limited contact with family, no television or radio, and no access to the commissary. The motion argues that holding an unconvicted detainee under such conditions violates due process.
The UK charges relate to four new accusers and include allegations of rape, assault, trafficking, and offenses involving indecent images of a child and extreme pornography, spanning from 2010 to 2017. The brothers already face similar charges in the UK from three other accusers between 2012 and 2015.
The Tates, who hold dual US and UK citizenship, moved to Romania in 2016 and were arrested there in 2022 on charges of luring women for sexual exploitation. They have denied all allegations. Their lawyers argue that the UK is attempting to bypass the Romanian proceedings, which have been delayed by legal issues.
Andrew Tate, 39, gained notoriety as a "Big Brother" contestant and has built a large following with his controversial views on masculinity and wealth. Tristan Tate, 38, has been involved in various business ventures with his brother, including webcam pornography production.
