Telangana HC orders refund of ₹3.32 lakh tuition fee after BHMS admission cancelled
Telangana High Court directs a private homoeopathy college to refund ₹3.32 lakh to a student whose BHMS admission was cancelled over her NEET score.
The Telangana High Court has directed a private medical college to return the full tuition fee of ₹3.32 lakh paid by a student whose admission to a homoeopathy course was later cancelled by the university.
Justice Juvvadi Sridevi, hearing the matter, held that the cancellation of admission — whatever the justification — cannot allow an institution to retain money paid for a seat the student was never permitted to occupy. Allowing the college to keep the fee, the court observed, would amount to unjust enrichment.
The petitioner, D. Shabari Priya, was allotted a seat in the Bachelor of Homoeopathic Medicine and Surgery (BHMS) course at Guru Nanak Homoeopathic Medical College and Hospital in Ibrahimpatnam in 2025 under the management quota. The allotment followed a letter issued by Kaloji Narayana Rao University of Health Sciences.
The university subsequently cancelled the admission on the ground that she had scored 128 marks in NEET, short of the 144 marks required. The court noted that the student should not be made to bear the financial consequences of a mistake, if any, committed by the university.
The order requires the college to refund the entire tuition fee paid by the student.
