Telangana High Court issues notices to two BRS MLCs in remand plea
Justice B.R. Madhusudhan Rao issued notices to BRS MLCs Thatha Madhusudhan and N. Naveen Kumar Reddy on a police petition against a local court's rejection of their remand.
The Telangana High Court on Monday issued notices to two Bharat Rashtra Samithi MLCs, Thatha Madhusudhan and N. Naveen Kumar Reddy, on a criminal petition filed by the police. Justice B.R. Madhusudhan Rao is hearing the matter, which challenges a local court's decision declining to remand the two legislators.
The case stems from an altercation with police outside the Assembly on September 7. The two MLCs were arrested the following day. The police registered offences under section 353 read with section 3(5) of the Bharatiya Nyaya Sanhita, along with provisions of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act — sections 3(1)(r) and 3(2)(vii).
The First Additional Chief Judicial Magistrate at Nampally declined to send the arrested MLCs to judicial remand, holding that the mandatory notices under section 35(2) of the Bharatiya Nyaya Sanhita had not been issued to the accused. The police then moved the High Court against that order.
In the petition, Sultan Bazar Assistant Commissioner of Police M. Mattaiah argued that the local court's direction to the accused to furnish personal bonds and two sureties of ₹20,000 each, which led to their release, was arbitrary and illegal. The ACP contended that the order effectively amounted to granting bail to the two MLCs.
The High Court has adjourned the matter to Wednesday for further hearing.
