TikTok and ByteDance to Pay $400 Million in US Children's Privacy Case
TikTok and ByteDance will pay $400 million to resolve US allegations that they violated children's online privacy laws, the Justice Department announced.
The US Department of Justice has reached a $400 million settlement with TikTok, ByteDance, and related entities to resolve a lawsuit over alleged violations of children's online privacy protections. The agreement ranks among the largest recoveries ever obtained under the Children's Online Privacy Protection Act (COPPA).
Under the terms, TikTok will pay $300 million immediately, with an additional $100 million due after a court order vacates a prior consent decree involving Musical.ly, TikTok's predecessor app. The settlement addresses claims that the companies collected and retained personal information from children without parental consent, as alleged in a 2024 complaint.
Associate Attorney General Stanley E. Woodward Jr. called the settlement a major victory for American children and parents, noting it secures substantial recovery while reinforcing safeguards for families. Assistant Attorney General Brett A. Shumate, who leads the Civil Division, said the resolution reflects the department's commitment to ensuring children receive the full protections Congress mandated.
The Justice Department noted that TikTok has undergone significant changes in ownership, management, and privacy practices since the lawsuit was filed. The company has introduced stronger safeguards for younger users, improved age-related controls, and enhanced parental oversight tools, according to the department.
The case, filed in the US District Court for the Central District of California, was handled by the Civil Division's Enforcement and Affirmative Litigation Branch on referral from the Federal Trade Commission. The department stressed that the claims are allegations only and no liability has been determined. The settlement aims to secure practical results while avoiding the delay and uncertainty of prolonged litigation.
