Trump Administration Appeals Court Order on Hudson Tunnel Funding

The Trump administration has filed an appeal against a court order that mandated the release of funds for the $16 billion Hudson Tunnel project, a critical rail link between New York and New Jersey. The move comes after the administration lost its latest attempt to halt the funding.

The project involves constructing a new commuter rail tunnel under the Hudson River and rehabilitating a century-old existing tunnel that carries over 200,000 passengers and 425 trains daily. The existing tunnel, damaged by Hurricane Sandy in 2012, requires frequent emergency repairs, causing significant disruptions on one of the nation's busiest passenger rail lines.

The funding dispute marks another flashpoint between the administration and congressional Democrats over a major infrastructure initiative. The project received approximately $15 billion in federal support under the previous administration. In October, the U.S. Transportation Department abruptly stopped releasing grant funds following a partial government shutdown. A federal judge subsequently ordered payments to resume in February.

The administration has cited concerns over potential cost overruns and compliance with rules prohibiting the use of diversity, equity, and inclusion policies in federal funding. The department had earlier stated the freeze was to ensure adherence to these regulations.

Construction was briefly halted in February but resumed after the administration released $235 million in previously withheld funding. The Gateway Development Commission, which oversees the project for both states, has separately filed a lawsuit in the U.S. Court of Claims to safeguard the funds from future freezes.

Around $2 billion of the project's federal allocation has been spent to date. The administration had previously offered to unfreeze the funds in exchange for Democratic support to rename Washington Dulles Airport and New York's Penn Station after President Trump, a suggestion that drew criticism from Democrats.
